1. CONTEST DESCRIPTION: The BIG LEAGUE CHEW HALL OF FAME EXPERIENCE Contest ("Contest") begins on or about January 18, 2018 at 12:01 AM Eastern Time (ET) and ends on May 1, 2018 at 11:59 PM ET ("Contest Period").

 

2. SPONSOR and JUDGE : Ford Gum & Machine Company, Inc., 18 Newton Avenue, Akron, NY 14001.

 

3. ADMINISTRATOR: Cohen-Friedberg Associates, LLC, Framingham, MA 01702 www.cfapromo.com.

 

4. ELIGIBILITY: The Contest is open only to individuals who: (a) will be aged 8 to 16 years old on October 1, 2017 (each an "Entrant"); (b) have their parents'/legal guardians' permission to participate in the Contest; and (c) are legal residents of the United States. Parental or legal guardian consent occurs when the Parent/Legal Guardian of a minor participant grants permission for the minor participant to participate and agrees on behalf of himself/herself and the minor participant, in writing, to be bound to any terms and conditions of the drawing (collectively an "Entrant").

 

5. HOW TO ENTER:

(a) Online: To enter online, visit the following website: www.bigleaguechew.com/essaycontest ("Website") and fully complete the entry form with the information requested. All requested information on the entry form at the Website must be completed to enter and to be eligible to win. Incomplete entries will be disqualified. Limit one (1) entry per Entrant.

The entry form has space for an essay written by the Entrant entitled "MY BEST BASEBALL DAY - EVER." All entries must be in the English language. Maximum story length is 108 words or less. Entries must be the original, unpublished work of the Entrant. Stories submitted will not be returned.

WARNING: ANY ATTEMPT BY AN ENTRANT OR OF ANY OTHER PERSON TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. IF ANY SUCH ATTEMPT IS MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEY'S FEES) FROM ANY SUCH ENTRANT OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING SEEKING CRIMINAL PROSECUTION.

Sponsor, its agents and employees are not responsible for the inability of any Entrant to complete or continue an internet entry due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries, including any injury or damage to any computer arising from or relating to participation in the Contest. Any use of robotic, macro, automatic, programmed or like entry methods will void all such entries, and may subject that Entrant to disqualification. In addition, Sponsor, its agents and employees are not responsible for late, lost, misdirected, mutilated, illegible or incomplete contest entries. No mechanically reproduced or automated entries permitted. Entry materials/data that have been tampered with or altered are void.

(b) Alternate Means of Entry: Entrant(s) can also submit an entry via mail by sending, in a stamped envelope via US Mail with your Name, Address, State, Zip Code, Phone Number, Email Address and essay (described above in (a), clearly printed or typed, on a 3" x 5" card or piece of paper to: Big League Chew Essay Contest, PO Box 330, Akron, NY 14001.

 

6. GRAND PRIZE:

The Contest has One Grand Prize Package ("Grand Prize") for a winning Entrant (the "Winner") and up to three family guests/travel companions. At least one guest must be a parent or legal guardian of the Winner as described in the Grand Prize Notes (below).

The Grand Prize will consist of the following:

• Accommodations for one Winner and up to three guests in Cooperstown, NY for the 2018 Hall of Fame Induction Weekend (July 27, 2018 – July 30, 2018).

• Airfare for the one Winner and up to three guests to and from either (i) Albany, NY or (ii) Syracuse, NY from the nearest commercial airport to the Winner's residence, plus transportation to and from Albany, NY or Syracuse, NY (respectively) to Cooperstown, NY.

• Induction Weekend VIP Package with tickets to all public events for Winner and up to three guests.

• One year Hall of Fame Benefactor Membership package for Winner.

• One $250 gift certificate to the Baseball Hall of Fame on premises store. Terms and conditions of the gift card apply.

Total approximate retail value of the Grand Prize is $9,000 (US).

Grand Prize Notes : All travel arrangements to/from Albany, NY or Syracuse, NY must be made through Sponsor's agent and on a carrier of Sponsor's choice. The Winner and travel companions must travel together on the same itinerary and have valid travel documents (e.g., government issued I.D., passport, major credit card, etc.) along with any other travel requirements in order to travel to the Grand Prize destination prior to departure, and failure to do so may result in forfeiture of Grand Prize. If in the judgment of Sponsor air travel is not required due to the Winner's proximity to Grand Prize location, ground transportation will be substituted for round trip air travel at Sponsor's sole discretion and no compensation will be provided for difference in value, if any. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. The Winner and his/her travel companions are solely responsible for satisfying all legally required conditions of travel. The Winner's Parent/Legal Guardian travelling with the Winner must have a major credit card to check-in to the hotel. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation or delay or any weather or airline issues that prevent the Winner and travel companions, if applicable, from traveling, in which event any missed portion of the Grand Prize is forfeited in its entirety and no substitution will be provided. All expenses and incidental travel costs associated with Grand Prize acceptance and use not expressly stated in the package description above as being provided, including but not limited to, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, travel of other type of insurance, taxes or other expenses are the responsibility solely of the Winner and his/her Parent/Legal Guardian. If the Winner or Winner's travel companion(s) is/are a minor, the Winner or travel companion(s) must be traveling with a Parent/Legal Guardian and the Parent/Legal Guardian will be required to execute and return a liability/publicity release. If the Winner is a minor, the Grand Prize will be awarded in the name of the Winner's Parent/Legal Guardian for the benefit of the minor.

Any forfeited Grand Prize may be awarded to the next ranked Finalist Entry with the highest Judges' score as determined by the Judges.

All expenses and costs associated with Grand Prize acceptance and use not expressly stated in the package description provided herein are the sole responsibility of the Winner, including all federal, state and local taxes.

 

7. JUDGING:

At the end of the Contest Period, all stories will be judged by an agent of the Sponsor in its/their sole discretion based on the following equally weighted criteria. Judges will be selected by the Sponsor in its sole discretion.

• Originality

• Humor

• Involvement with the game of baseball and the experience related.

In the event of a tie, such tied Entry submissions will be re-judged by the Judging Panel/Judge based on the same criteria as listed above to determine the Winner between all tied entries. If a tie continues, a third party Judge will be selected by the Sponsor at its sole discretion, to determine the winning entry.

After all essays have been judged, the top 9 essays will be provided to a Judging Panel/Celebrity Judge selected by the Sponsor and the National Baseball Hall of Fame and Museum, Inc. (at their sole and absolute discretion). This panel will select the Winner of the Contest and two alternates. The Winner will be notified by telephone and/or mail and/or email, using the contact information provided or collected at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. If, despite reasonable efforts, the potential winner does not respond within nine (9) days of the first notification attempt, or if the prize notification is returned unclaimed or undeliverable to the potential winner, the potential winner will forfeit the prize and an alternate winner may be selected. An alternate winner will be defined as the entry with the next highest Judges score ("Alternate Winner"). Sponsor, in its sole discretion and time permitting, will attempt to contact up to three (3) potential winners of the Grand Prize in accordance with the above procedure, after which the Grand Prize may go unawarded if it remains unclaimed. If any potential winner is found to be ineligible, or if the Entrant has not complied with these Official Rules or declines the Grand Prize for any reason prior to award, such potential prize winner will be disqualified and an alternate prize winner may be selected.

If the potential Winner is less than 13 years of age , an email will be sent to the potential Winner's Parent/Legal Guardian with the required Winner documents. Failure of a Parent/Legal Guardian to respond to such email as instructed in the email may result in the minor's disqualification.

Potential Grand Prize Winner's Parent/Legal Guardian will also be required to complete, sign and return an Affidavit of Eligibility/Liability Release and W-9 tax payer request for identification, and, where lawful, a Publicity Release, within five (5) business days of attempted notification or the Grand Prize may be forfeited. The Grand Prize will be awarded in the name of the Parent/Legal Guardian for the benefit of the minor.

 

8. RIGHT TO CANCEL OR SUSPEND CONTEST:

If for any reason the Contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest. In such event, no prize of any kind will be awarded.

 

9. DATA PRIVACY:

By entering, Entrants agree that personal data ("Personal Data"), including, without limitation, the Entrants' name and address, may be processed, shared and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. Entrants also agree that such Personal Data may also be used by the Sponsor in order to verify the participant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the Contest. While the Sponsor is committed to undertaking reasonable measures to protect the privacy, accuracy and reliability of the Personal Data submitted and to protect such information from loss, misuse, unauthorized access, disclosure, alteration and destruction, the Sponsor notes that the internet is not a perfect service medium and data transmission is not guaranteed to be secure. The Sponsor uses, and will use, a variety of security measures to insure the security of the Personal Data collected during the Contest. However, the Sponsor cannot and does not warrant the security of the Personal Data which is submitted as part of the Contest and cannot and does not warrant that such Personal Data will not be intercepted unlawfully by third parties. When any information is provided to the Sponsor as part of the Contest, including Personal Data, such submission is done at the Entrants own risk. The collection, use and disclosure of Personal Data about the Entrant is solely for the purpose of administering this Contest. Entrants' personal information will be stored in accordance with the laws and rules of the United States, as applicable. The Personal Data will be held primarily in an electronic database. 10. PUBLICITY:

Except where prohibited by law, participation in the Contest by submitting an entry constitutes the Entrant's consent for the Sponsor and its designees to use the Entrant's name, likeness, prize information, City and State of residence for promotional purposes in any media without further consideration or notice to the Entrant.

 

11. GENERAL CONDITIONS:

By participating in the Contest, each Entrant agrees to the following:

(a) The Website database clock will be the official time keep for online entries in the Contest. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor's satisfaction, the affected entry will be deemed ineligible. The Sponsor and its agents and affiliates shall not be responsible for incorrect or inaccurate entry information whether caused by the Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of the entries in the Contest. The Sponsor assumes no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of entries.

(b) The Contest is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eight (8) and whose Parent/Legal Guardian has internet access or access to the US Mail.

(c) Employees, officers and directors of Sponsor, its respective parent and affiliate companies and advertising and promotion agencies, as well as members of the immediate families (spouses, parents, siblings and children, and each of their respective spouse, regardless of where they reside) or households (whether related or not) of any of the above are NOT eligible to participate.

(d) Each Entrant is responsible for complying with these Official Rules. All entries become the property of the Sponsor and none will be returned. No correspondence will be entered into except with the selected Winner who will be notified in accordance with these Official Rules. Contest winners must consent to the use and disclosure to third parties and to the public, of their names, photograph, voice, video footage and/or statements for publicity purposes without compensation, in any future publicity carried out by Sponsor.

(e) All Entrants in this Contest and any Winner of the Contest agree to release and hold harmless the Sponsor and their respective parents, subsidiaries, related companies, franchisees, and each of their respective officers, directors, employees and agents from and against any claim or cause of action arising out of participation in the Contest or receipt or use or misuse of any prize, including, without limitation: (1) incorrect or inaccurate transcription of entry information or late, lost, stolen, illegible, incomplete, misdirected, or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the Contest; (5) electronic or human error which may occur in the administration of the Contest or the processing of entries; (6) any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from the entrant's participation in the Contest or from downloading any material from the Sponsor's web sites, regardless of whether the material was prepared by the Sponsor or any third party, and regardless of whether the material is connected to the Sponsor's web sites by hypertext link. If, for any reason, an Entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the Entrant's sole remedy is another entry in either of the two drawings described in these Official Rules. If it is not possible to award another entry due to discontinuance of the Contest, or any part of it, the Sponsor, in their sole discretion, may elect to hold a random draw from among all eligible entries received up to the date of discontinuance for the prize offered herein. No more than the Grand Prize will be awarded.

(f) The Grand Prize may be forfeited and an Alternate Winner may be selected (as provided in these Official Rules) unless the Winner (by his/her Parent/Legal Guardian) signs and returns, within nine (9) days of the date of the accompanying cover letter, Sponsor's standard declaration and release forms, confirming eligibility and compliance with these Official Rules and releasing the Sponsor and its designates persons (each, a "Releasee") from all liability caused by, resulting from, or arising out of the acceptance or use of the Grand Prize, the use of any personal information or the use of merchandise or services purchased in relation to winning the Grand Prize.

(g) The Sponsor and their respective affiliates and their respective advertising and promotional agencies, assume no responsibility for lost, stolen, delayed, damaged, or misdirected entries or for typographical or other production errors. Any attempt to deliberately undermine the legitimate operation of this contest is a violation of the criminal and civil laws of the United States. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.

(h) The Contest is subject to all applicable federal, State, municipal and local laws, by-laws and regulations and is void where prohibited as provided in these Official Rules.

(i) In the event of any inconsistency or discrepancy between the terms and conditions of these Official Rules and statements contained in any contest-related materials, the terms and conditions of these Official Rules shall prevail, govern and control.

(j) Any and all taxes assessed as a result of receiving a prize will be the responsibility of the Winner's Parent/Legal Guardian. Any other costs of the Contest are the responsibility of the Winner. See Grand Prize Notes above.

(k) Sponsor assumes no responsibility for failure of the Internet, Twitter or the Website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion. The Sponsor reserves the right, in their sole discretion, to cancel or suspend the Contest should a virus, bug or other cause beyond its reasonable control corrupt the security or proper administration of the contest.

(l) The Sponsor reserves the right, in their sole discretion, to change the terms of this Contest or to cancel, suspend or modify the Contest if fraud or technical failures impair the integrity of the Contest as determined by the Sponsor, in its sole discretion, and may award any prize based on eligible entries received prior to the cancellation. In the event an insufficient number of eligible entries are received and/or Sponsor is prevented from awarding the prize or continuing with the Contest as contemplated herein by any event beyond Sponsor's control, including but not limited to, fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, Sponsor will (if possible) judge all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such judging shall be each Entrant's sole and exclusive remedy under such circumstances.

(m) Except where prohibited, Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by court situated in the State of New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) Entrants hereby waive all rights to claim Special Damages and all rights to have such damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Contest shall be governed by, and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules.

(n) By participating, an Entrant also agrees (a) to be bound by these Official Rules; and (b) that the decisions of the Sponsor are final and binding with respect to all matters relating to the Contest. By accepting a prize, each winner agrees that the Sponsor may use the winner's name, and/or voice in any publicity or advertising relating to the Contest without further compensation or approval (except where prohibited by law).

(o) The National Baseball Hall of Fame and Museum, Inc. is solely a prize supplier and not a sponsor or co-sponsor of the Contest. By entering, all Entrants and any Winner of the Contest acknowledges and agrees that the National Baseball Hall of Fame and Museum, Inc. has no liability whatsoever with respect to the Contest and any related activities except to provide the prizes described in these Official Rules.
